Terms of Use

01Speed, records and Ghost Rides: racetrack use only

The speedometer, speed sessions, records, speed boards and Ghost Rides are designed and intended solely for use on a racetrack, a closed circuit or private land that is closed to public traffic. Using them to measure, record or chase a speed on a public road, or anywhere the law does not permit it, is outside the intended use, is not permitted and is a material breach of these terms. Any such use is entirely at your own risk. The app records a session automatically whenever the car is moving; a session recorded on an ordinary drive is not a challenge, and its figures are never an invitation to drive fast. Always comply with the traffic rules and the local law of the place where you are driving. You alone are responsible for obeying the speed limits and traffic laws that apply there, and for the safety of yourself, your passengers and everyone around you. The app repeats this where a ride is set up and started, as a reminder rather than a separate rule — the restriction applies whether or not the reminder is on screen.

02Territory

Territory counts the map hexagons your drives pass through. It never uses or rewards speed. Drive normally, always follow traffic rules, speed limits and local law, and never let the app distract you while driving. The developer accepts no responsibility for how, where or at what speed you drive.

03You drive at your own risk

Driving fast is dangerous, even on a closed course. You take part in any drive, session or ride voluntarily and at your sole risk, and you accept full responsibility for every consequence of your driving — including any accident, collision, injury, death, damage to a vehicle or other property, fine, penalty or prosecution — whether it happens on a track or on a public road. Where Rushing only records and displays figures; it does not control your vehicle, does not judge whether a speed is safe or lawful, and does not verify where you are driving. To the fullest extent the law allows, you release Inoxoft, its owners, developers and contributors from every claim, demand or loss that arises from your driving or from your use of the app, and you will hold them harmless against any claim brought by a third party as a result.

04Do not use the app while driving

Set the app up before you move off. Read the screen only when you are stationary, or through CarPlay where your car allows it. Where Rushing is not a navigation aid and must never take your attention from the road.

05Agreeing to these terms

These terms are an agreement between you and Inoxoft, who publishes Where Rushing. By creating an account or using the app you accept them. If you do not accept them, do not use the app. You must be at least 18 years old to hold an account.

06Your account

You need an account to record sessions. Keep your password to yourself and use a nickname you are happy for other drivers to see. You are responsible for what happens under your account. We may remove a nickname that impersonates someone else or that other drivers would reasonably find offensive.

07Records and the leaderboard

Speeds are measured from your phone GPS and are approximate. A record is kept only when the signal was good enough to trust it. Your top speed, nickname, country and car appear on the leaderboard for other drivers unless you hide yourself in Settings. We may remove a record that was obviously not set by driving.

08Availability and accuracy

Where Rushing is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not promise that the app will always be available, uninterrupted or accurate. GPS can be wrong and a phone can lose signal. Nothing in the app should be relied on where being wrong would be dangerous.

09Limitation of liability

To the fullest extent the law allows, Inoxoft and everyone who built or maintains Where Rushing accept no liability whatsoever for any accident, collision, injury, death, damage, fine, penalty, prosecution or other loss, direct, indirect or consequential, arising from your driving, from your use or misuse of the app, from use on a public road or anywhere outside a closed course, or from any figure, time, position or comparison the app reported. The app is a free recording tool; it is not a safety device and must never be relied on as one. If, despite the above, liability is found, it is limited in total to the amount you paid for the app, which is nothing. This section does not exclude or limit any liability that cannot lawfully be excluded or limited in your country — for example for death or personal injury caused by our own negligence, or for fraud — and if you are a consumer, your statutory rights are unaffected.

10Changes to these terms

We may change these terms as the app changes or the law requires. The date at the top shows when they were last changed, and the current version is always in the app and on our website. If a change matters to you and you do not accept it, delete your account.

11Ending your use

You can delete your account at any time from Settings. We may close an account that breaks these terms. Your recorded top speed stays on the leaderboard as an anonymous entry so the rankings of other drivers do not change.

12Governing law

These terms are governed by the law of Ukraine, and disputes about them are heard by the courts of Ukraine. If you live in the European Union or the United Kingdom, this does not remove the protections your own law gives you and cannot take away, and you may also bring a claim in your own courts.
